New, efficient and built for modern living, or established, immediate and ready to inspect? The right answer depends on much more than whether you prefer a new kitchen.

The honest answer

It is not simply new versus old

Ask buyers whether they prefer off-plan or resale property and most will answer instinctively. Some want the clean lines, large terraces and energy efficiency of a brand-new development. Others want to walk through a finished home, understand the exact view and collect the keys quickly.

Both positions are reasonable. The mistake is assuming that one category is automatically safer, cheaper or better value than the other.

My own preference is often off-plan, particularly for international buyers who are not in a rush to move. A well-selected new development can offer a better standard of design, lower maintenance, staged payments and a property that should remain attractive to future buyers. However, that preference only holds when the developer, location, licence position, guarantees, layout and price all withstand proper scrutiny.

The strongest off-plan purchase is not simply the newest property. It is the right unit, in the right development, bought at the right stage and with the right legal protection.

Equally, the strongest resale purchase is rarely just the cheapest home. It is one whose condition, community, location and realistic renovation costs have all been properly assessed.

The two markets solve different problems. Understanding those differences is more useful than trying to declare one universal winner.

  • Access to prime beachfront, town-centre and older golf locations
  • Renovation can create a more individual home

What makes off-plan so attractive?

The biggest advantage is not simply that nobody has lived in the property before. New developments are usually designed around how buyers want to live today: open-plan kitchens, larger terraces, en-suite bedrooms, underground parking, lifts, communal pools and better indoor-outdoor flow.

On the Costa del Sol, this matters. Many older apartments were built when outdoor space, energy performance and remote working were less important. A modern two-bedroom apartment may therefore feel more usable than a larger but poorly configured older property.

Lower maintenance is valuable

A resale property can appear cheaper until the buyer starts replacing air-conditioning systems, windows, electrics, bathrooms, kitchens or waterproofing. With a new property, the early years should normally involve fewer major maintenance decisions, although snagging and follow-up with the developer remain essential.

Staged payments can help buyers plan

Off-plan purchases normally involve payments at agreed construction milestones, with the balance due at completion. The exact schedule varies between developments. This can suit buyers who are building their funds over time, selling another property or planning a future relocation.

Important:

A staged payment plan is not the same as developer finance. Buyers still need to ensure they can fund the completion balance and should discuss mortgage timing with a broker before committing.

Buying early can create choice, but not guaranteed profit

Early buyers may secure better choice of floor, orientation, terrace or view. A successful development may also increase its prices through later sales phases. However, this should be treated as a possible benefit rather than a guaranteed return. The original price still needs to make sense against completed homes and competing projects.

Where resale property can be stronger

Resale gives you certainty. You can stand on the terrace at the time of day that matters to you, hear nearby roads, inspect the communal areas and understand exactly what surrounds the property.

That certainty is especially valuable in areas where a small change in elevation, orientation or neighbouring building can transform the experience of a home.

Location can outweigh specification

Some of the Costa del Sol’s most established locations have limited land available for new construction. Buyers who want genuine walking distance to an old town, a frontline beach position or a mature golf community may find that resale offers the strongest opportunities.

You can move sooner

A resale purchase can often complete within a matter of months, subject to legal checks and agreement between the parties. Off-plan buyers may wait one, two or more years, and estimated delivery dates can move.

There may be more room to negotiate

An individual seller may have a mortgage, relocation, inheritance or timing issue that creates flexibility. Developers tend to protect headline prices, particularly when a project is selling well, although incentives or specific unit negotiations may sometimes be possible.

The risks buyers often misunderstand

Off-plan risk is mainly about delivery and interpretation

You are buying from plans, specifications, renders and contractual documents rather than from a finished home. Room sizes may feel different in reality, views can change as later phases are constructed and completion can be delayed.

This is why the legal paperwork, developer record, planning position, building licence, payment guarantees and exact specification matter so much.

Resale risk is mainly about condition and hidden cost

A resale home is visible, but not every problem is obvious. Damp, ageing installations, unauthorised alterations, community disputes, unpaid debts or discrepancies between the physical property and official records can turn a seemingly straightforward purchase into an expensive one.

The key distinction:

Off-plan buyers need to investigate what will be delivered. Resale buyers need to investigate what already exists.

Taxes and buying costs in Andalucía

The tax structure differs. A new-build first sale is generally subject to 10% VAT, together with Stamp Duty, known as AJD. A resale purchase is generally subject to Transfer Tax, known as ITP. Andalucía currently applies a general ITP rate of 7%, while the general AJD rate is 1.2%, subject to applicable reductions and the buyer’s circumstances.

Legal fees, notary costs, registration, mortgage expenses where applicable and other purchase costs must also be budgeted. Buyers should obtain an individual cost calculation rather than relying on a single headline percentage.

Tax rules and reduced rates can change. Your lawyer or tax adviser should confirm the position for your purchase before contracts are signed.

Protection does not remove the need for due diligence

Spanish law provides important protections for buyers of new property. Advance payments required during construction must be protected in the circumstances set out by law, normally through an insurance policy or bank guarantee. Buyers should have their lawyer verify that each payment is properly covered and made to the designated account.

The Spanish Building Act also establishes responsibility periods for different categories of construction defects, broadly covering finishing defects, habitability issues and structural defects over different periods.

These protections are valuable, but they are not a substitute for choosing carefully. A guarantee may help when something goes wrong. The better outcome is to reduce the likelihood of the problem in the first place.

A practical way to make the decision

Your timescale, appetite for work and preferred location should drive the choice more than a general belief that new or resale is always superior.

Off-plan may suit you better when:

  • You do not need to move immediately
  • You value modern design and energy efficiency
  • You want lower early maintenance
  • You can manage staged payments and completion funding
  • You are comfortable buying from detailed plans and specifications
  • You want a property with broad future buyer appeal

Resale may suit you better when:

  • You want to use the property soon
  • You need certainty over the exact view and surroundings
  • Your preferred area has limited new construction
  • You want to negotiate with an individual owner
  • You enjoy renovating or personalising a home
  • You have inspected and budgeted for the property’s true condition

Good marketing can make almost any development look attractive. These are the points that determine whether it is a strong purchase.

Review completed projects, delivery history, build quality, ownership structure and financial credibility.

Your independent lawyer should verify land ownership, licences, planning, contracts and payment protection.

Assess orientation, floor, privacy, access, future phases, road exposure and the realistic view from that unit.

Separate what is contractually included from furniture, decoration and landscaping shown only in marketing images.

The complete budget

Include VAT, AJD, legal costs, upgrades, furniture, utility connections and the cash required at completion.

Compare the price with completed new homes, quality resales and other developments due to finish at a similar time.

Our conclusion

Why we often favour off-plan

For many international buyers, a carefully chosen off-plan property offers the most balanced package: modern design, efficient construction, appealing communal facilities, lower immediate maintenance and time to prepare for completion.

It can also be easier to own from abroad. A new apartment with modern systems and little immediate work may be considerably simpler than managing a renovation or inheriting years of deferred maintenance.

However, we would never recommend off-plan simply because it is new. Some developments are overpriced. Some locations look better on a map than they feel on the ground. Some units within excellent developments are poor choices because of orientation, access or future construction.

Our preference is therefore conditional: good off-plan is often better than average resale, but a strong resale property is better than the wrong new development.

The real job is not choosing a category. It is comparing the strongest properties in both categories and understanding what you gain, what you compromise and what the complete purchase will cost.

Frequently asked questions

Off-plan and resale property in Spain

Is off-plan property cheaper than resale property?

Not automatically. It may offer better specifications and lower maintenance, but the asking price can carry a premium. The correct comparison is with similar completed properties in the same location and with competing developments.

Can an off-plan completion date be delayed?

Yes. Construction and administrative timelines can move. The contract should clearly address the estimated delivery period, permitted extensions and the buyer’s remedies, and it should be reviewed by an independent lawyer.

Are off-plan stage payments protected?

Spanish law provides for the protection of advance payments in qualifying new-build purchases. Your lawyer should verify the guarantee or insurance arrangements, the designated account and the protection applying to each payment.

Is resale better for negotiation?

Often, but not always. Individual sellers can be more flexible because of their own circumstances. Developers usually seek to protect advertised prices, although certain units, upgrades or incentives may still be negotiable.

Which is better for rental investment?

The location, permitted use, community rules, purchase price and likely demand matter more than whether the home is new or resale. New developments can appeal strongly to tenants, but an established resale property in a proven location can perform equally well or better.
